Please read these Terms of Service (“Terms”, “Terms of Service”) carefully before using the peonyparadise.com website operated by Adelman Peony Gardens (“us”, “we”, or “our”).

Your access to and use of the Service is conditioned on your acceptance of and compliance with these Terms. These Terms apply to all visitors, users and others who access or use the Service.

By accessing or using the Service you agree to be bound by these Terms. If you disagree with any part of the terms, then you may not access the Service.


We may terminate or suspend access to our Service immediately, without prior notice or liability, for any reason whatsoever, including without limitation if you breach the Terms.

All provisions of the Terms which by their nature should survive termination shall survive termination, including, without limitation, ownership provisions, warranty disclaimers, indemnity and limitations of liability.


In order to post, link, store, share or otherwise make available certain information, text, graphics, videos, or other material, you are responsible for following all public and private laws and practices and are subject to restriction from our Service upon violation of such laws. Some Content may be restricted to logged in users only. Refrain from sharing this data with those outside of our organization.


Adelman Peony Gardens and its associates attempt to be as accurate as possible. Our goal is to provide you with healthy, true to name, vigorous roots with 3-5 eyes that will transplant well and prosper with your good care. Bush peonies are guaranteed for USDA zones 2-8 and tree peonies are guaranteed for USDA zones 4-8 if you follow our planting directions. We will gladly replace any root if not true to name.

However, Adelman Peony Gardens does not warrant that product descriptions or other content of this site is accurate, complete, reliable, current, or error-free. If you are not happy with the peonies you receive, please contact us via phone (503) 393-6185 or by email: info@peonyparadise.com within two days of the package being delivered to you. Once the two day window has passed you assume the liability of the planting and care for the peonies.

We will not be held responsible for the peonies after they are planted. There are many components out of our control. You are responsible for their growth and care. We cannot guarantee our roots after they are planted. Please feel free to reach out to us for any help or advice you need. We are happy to help you in any way possible to make your growing experience successful.

All products are subject to availability, and we cannot guarantee that items will be in stock. We reserve the right to discontinue any products at any time for any reason including poor plant growth/poor growing season. Prices for all products are subject to change.


Purchases and Payment

We accept the following forms of payment: Discover, MasterCard, Visa, and PayPal. Money order or check by mail only. You agree to provide current, complete, and accurate purchase and account information for all purchases made via the Site. You further agree to promptly update account and payment information, including email address, payment method, and payment card expiration date, so that we can complete your transactions and contact you as needed. Sales tax will be added to the price of purchases as deemed required by us. We may change prices at any time. All payments shall be in U.S. dollars.

You agree to pay all charges at the prices then in effect for your purchases and any applicable shipping fees, and you authorize us to charge your chosen payment provider for any such amounts upon placing your order.

We reserve the right to correct any errors or mistakes in pricing, even if we have already requested or received payment.

We reserve the right to refuse any order placed through the Site. We may, in our sole discretion, limit or cancel quantities purchased per person, per household, or per order. These restrictions may include orders placed by or under the same customer account, the same payment method, and/or orders that use the same billing or shipping address. We reserve the right to limit or prohibit orders that, in our sole judgment, appear to be placed by dealers, resellers, or distributors.

Returns/Refunds Policy

We will not make substitutes to your order without your prior consent. If we are unable to provide you with a high quality root due to circumstances beyond our control, we will issue a full refund or offer a substitution. Any refunds will only be for the purchase price, excluding shipping cost.

We are not responsible for plant loss due to weather/climate, neglect, animals, zone incompatibility, or performance in following seasons. If you live in a zone that is not suitable for growing peonies, you are welcome to give peonies a try but we will not replace any lost plants. Our customers have a 99.7% success rate, so we know you will be pleased with your plants.

Adelman Peony Gardens has no control over, and assumes no responsibility for, the content, privacy policies, or practices of any third-party web sites or services. You further acknowledge and agree that Adelman Peony Gardens shall not be responsible or liable, directly or indirectly, for any damage or loss caused or alleged to be caused by or in connection with use of or reliance on any such content, goods or services available on or through any such web sites or services.


We reserve the right, at our sole discretion, to modify or replace these Terms at any time. If a revision is material, we will try to provide at least 30 days’ notice prior to any new terms taking effect. What constitutes a material change will be determined at our sole discretion.
